nerosis Posted September 6, 2008 Share Posted September 6, 2008 I had a crash in my old car over a year ago now, around 14 months. i flipped my car so it was a write off, but in the crash i knocked over a lamppost. So the ambulance and police came and the lamppost man to turn of the electricity to the lamppost. i didnt claim on my insurance as it was a cheap old clio and no1 else was involved and wanted to keep the no claims. Now 14 months later the local council has decided to send me a notice saying i ow them £800 for the lamppost. Regardless of no prior notice or notice at the time of going to be charge for the lamppost, and if they said i wud have to pay for it i wud have claimed on the insurace (as i wudnt save £800 for noclaims) Do i have a leg to stand on as its been over a year and no prior notice or lettter that i was going to have to pay this fine? Starletraje Posted September 6, 2008 Share Posted September 6, 2008 in all honesty... i wouldn't say they would chase it that hard...im not sure what the small claims limit is but if it is over that or just under they won't chase it cause it will cost them more to chase than they would get out of you. thing is... here we are 14 months later and you have a new insurance policy, and why would your current company pay out, so they will want YOU PERSONALLY to foot the bill... tell them where to poke it in my opinion...write them a letter stating at the time if they had informed you that there was damages to be paid you would have claimed on your insurance, but they did not inform you of this until 14 months later, and as such have no means to pay the sum they are asking Quote Link to post Share on other sites

If you have not heard from them in 14 months they cannot suddenly turnaround and say they want £800. I can't remeber what the legal term is but i'll find out at work on Monday. I would get proper legal advice & representation as Councils can be nasty. They will send baliffs round and put CCJ's on your record. DON'T just ignore it.
