Idrees Posted April 25, 2007 Share Posted April 25, 2007 Hello everyone!The lad who bought my brothers car is causing us havoc!Hes making threats about what he will do if he doesn't get his money back.. But i'm thinking we don't have to return a penny to him because its a private sale?He claims theres loads of things wrong with the car, hes saying the second gear syncro is damaged and the brakes are screeching, and quite a few other things. But i think its a load of rubbish otherwise we would have obviously stumbled across the same problems? The car also passed MOT 8 days before he bought it..Any help appreciated.. I've told my brother to report him to the police and tell them he is making threats over a private sale.. Is it the right thing?Thanks ;) Quote Link to post Share on other sites

As far as any cars i've sold once cash and documents are exchanged then tough shit if it breaks down 5 seconds or 5 years later! If he never test drove it and checked it though out then thats his tough crap in my opinion. He said: IF there was anything wrong with the car that you didnt tell him about then he has a bit of an argument against you. We have had cases in the past where there has been people who this has happened to and they won due to the dangerous nature of the faults. Usually you have to point out anything wrong with the car BUT There are plenty of ways he could have spotted any faults. Firstly a good test drive would have found them which is what you should do as a rule anyway when your buying a privatly sold car. He could have given the car a good check over which again as a rule you should do. He could have also got a mechanic to check over the car plus there are many services like an RAC inspection you can have on cars you are buying. If you didnt tell him that there was something wrong you argument could have been he didnt ask.The car passing its MOT just over a week before is also a good point as that is a recognised certificate saying its road worthy. Usually on an MOT test they would tell you if anything was wrong.He probably been caning it for 5 days!!!He drove the car away so if it was sqealing at crunching into gear then he should of brought it backThis is very true Sparky. He has left a considerable gap of time to come back and complain. Like you said he could have been ragging it a lot. Its an old car that doesnt have a warrenty so he cant rag it and expect replacement parts or his money back.The most important thing is that he didn't test drive the car and it was sold as seen. If the brakes were funny the MOT should of sorted them, and at least told about a dodgy gear box (I of course presume you used a decent/honest MOT station)Out of interest, how did he drive the car away? rob_bower Posted April 27, 2007 Share Posted April 27, 2007 its tough shit he has got no come back when i sold my fiesta the exaust fell of at the mani the week after but it wa sold as seen and had been put through an mot the month befor and had been garaged since so i got in touch with citizens advice who confirmed as long as it was sold as seen (to cover your back you best to write this and give them a receipt with both signitures or write it in the ebay listing) then there was feck all for him to do!! Bourkey Posted April 27, 2007 Share Posted April 27, 2007 Another small note to add is that it is illegal to sell a car with faulty brakes.If the car hasnt been driven that often before the sale then the brakes will make some noise for a week or two until they bed in again. It was like that with mine. I was worried about them when i first picked up the car. I gave them a check before i set off to check but after about 100 miles on the way home they didnt make a noise.And getting violent is not the answer to this problem so i dont know why he is threatening you at all.
