Where do i stand with this ? Legal Issue.

Recommended Posts

Recently had my car back from the tuner (wont say which one) where i spent more than £8500 in one sitting, car was running fine boosting as it should very strong and very fast after 2 - 2 and a half weeks i noticed a small puff of bluey/white smoke when stopped at the lights and now doing it when driving, speeding up, coming down the gears and at idle.

We had a chat on the phone and i had previously had a boost leak and could not find it, it was then discovered being right at the back of an I/C pipe so i popped it back on and was told it may smoke for a little bit due to having the boost leak but it should clear, i though ok great should be fine, it didnt stop smoking and only got worse, I was then told to drive the car for another week and if it didnt stop they would get the car back in and then have it fixed although this is where the problem lies.

I would have to pay to take it back to them train it home and then train it back down and drive it home, so i decided to have the car collected, last time i had the car collected from the same guy cost me £250 which was fair enough as i was sending the car to them, after asking if i would be helped out with the price of the pickup i was offered £100 which tbh is absoloutley nothing for the money i have recently spent on the car at their garage, i will also have to pay to have it dropped off as i work every second weekend and im not wasteing my weekend off going to collect it when it should be running absoloutley perfect, fair enough i chose the garage 3 hours from my home but I shouldnt have to pay to have it picked up when its faulty and it wasnt my fault.

So where do i stand with this do i just pay it or do i fight my corner and argue that i shouldnt be paying to send the car to them as i paid them all that money to make the car perfect and it isnt through no fault of mine. Car is still under warrenty

Also due to this problem i am missing scotlands biggest car show on sunday which i hoped my car would have been there for and missed loads of events due to delays with the car as it was with them for around 6 months, im shocked that someone with such a rep could not offer the delivery for free and 2 that the car has actually failed. Sad to say that after me not driving it for 10 months 4 out of the country and 6 in their possesion it just seems when i try to do things right it never works out for me always spending money on the best parts and garages and their are delays and faults, really feel like im loosing the love for the scene and i am honestly contemplating letting her go once she is fixed as im scared to drive her incase this keeps hapening its just not practical.

thanks alot for any input guys it is most appreciated,Chris

HHAHA poker face, yeah he is some guy ! exactly mate i spent the money that was for the car on the car and then a bit more they are at fault thus far untill its stripped and they can say maybe a manufacture fault in which case isnt theres but they SHOULD be paying to take the car down, not good business .

Hmmm 2 big complaints within a a very short time

At least the issue is being dealt with I'm the correct manor and said company is going to sort the issue out that's more than what some companies would have done and I'm afraid nothin is set in stone when it comes to modified parts my mates are big into fords and some of there big priced parts etc dont even come with a warranty on em when purchased

its not so much a complaint or having a go guys i just want to know should it be me or the garage that pays for delivery, like i mentioned i dont want to fall out with them over something stupid but i cant afford to have it picked up and want to known where i stand.

yes i know that it is good of the garge to offer warrenty and stand by there work but if my above comments were read i have no doubt of the garage building a good car this could be purely bad luck, faulty part which have nothing to do with the garage/tuner

Regardless of company used mate in this kind of situation it really is down to a companies disgression as u would have to spend more

Money on a specialist to prove that it was the other companies fault before any liability could be brought upon them when it comes to this kind of situation most companies will do there best to try help u out as when it comes to what we do for our jollies reputation is everything my mate brought an Evo for 14k brand new forged lump folder full of receipts which in turn after 24hrs of owner ship it went bang and the tuning company would take no responsibility for it as they said they cannot be held responsible for the way it has been drivin and that could of caused it to go Bang etc so he then laid another company to strip to find that the receipts for parts were fony as they did not match the actual parts in the engine and even then they only offered replacement parts and not to fix it .

I'm sure all will get sorted in the end mate :) don't lose the love :(

i wouldnt like to have to spend money to prove anything as such and would hope/think the company in question would hold their hand up if it was a fault of theirs, and i am not trying to damage anyones rep, i have alot of time for the company/people who work there and have done me alot of favours but id rather know now before i pay for sending it down if its up to me or the garage to foot the bill, i would have hoped/though that after all the money spent a gesture of good will would be to bring the car down and drop it back off not offer 100 quid which would still leave me alot out of pocket.

I don't think the problems having happened is the main issue, problems happen. It's how they look after the customer that matters.

It is a tough situation for both sides though. Kind of like if you buy a part with a warranty, they wouldn't pay the cost of fitting and removing it if you get me. Also the traveling is why I would be looking at more local traders now a days.

Chris,

Sorry to have to read something like that in your first post especially after spending that much money! Terrible thing and must feel absolutely gutting.

IMO, you shouldn't have to pay a single penny. It should 110% still be under some sort of warranty from the guys above, therefore it should be up to them to rectify the issue because after all it was in their hands when the car was built, tuned, bla bla. All you did was drive it how it should have been driven, nothing you can do exactly right?

I'm sure you'll get it sorted mate, it seems like they will take care of things and hopefully as said leave it up to themselves to rectify it!

Will be good to see what happens so be sure to update whatever happens fella.

Hope all is ok since your last major post in this section man, take it easy! x

i know it is a tricky one and its nothing to do with the build just that ill be 400 quid out of pocket if i pay for it and tbh im not in a postiion to do that atm, the reason i went with the company is they are good guys and know what they are doing so i put my trust in them.

cheers Rbz :) i am gutted to say the least, there is always light at the end of the tunnel right enough but its dimming a little each time i take a hit like this

parts and build is under warrenty but like you said i shouldnt have to pay anything because i shouldnt have even accounted for this as nothing should have went wrong, it has and now it has to be sorted mate, although it doesnt state that they will bring the car back to them should any problems arise, i was told when i picked the car up and i quote " any problems atol please pick up the phone" it wasnt a case of just cheers cyah later

again stressing i am in no way worried about aftercare in the sense when its fixed ill have a bill just the fact i cant afford to get it down there and in my eyes i shouldnt be paying for it, im sure the company and myself will sort the issue and this was in no way a dig at them purely to see what the script is with it all, and again i dont want to fall out with them even though i doubt it would come to that they are super nice guys and go the extra mile when i asked for things just not putting my hand in my pocket again unless its for petrol

it wouldnt be as bad if it was fixed on the day and i could drive it down and back but ill have to leave it with them and train it home and back down which isnt cheap at the best of times.

thanks for the comment though mate much appreciated ill let you know how i get on but im sure we will get it sorted.

I'm absolutely gutted for you Chris, IMO you shouldn't need to pay anything especially after spending that amount of money and the time you had to wait to get it back
